Terms and Conditions of Sale

Scope

These Terms and Conditions apply to all sales concluded by AGS S.R.L. via its website AGS-LAB.COM or any other sales channel, whether for natural or legal persons.

Orders

• The customer is solely responsible for information provided during ordering. AGS S.R.L. cannot be held responsible for errors made by the customer.

• Order registration by AGS S.R.L. serves as proof regarding the nature, content and date of the order.

• AGS S.R.L. will confirm order acceptance by email. The sale is only considered concluded upon payment validation.

• AGS S.R.L. reserves the right to refuse or cancel any order, particularly in case of payment issues.

• If the ordered product is unavailable, AGS S.R.L. will inform the customer and offer an equivalent product or refund.

• Only legally capable persons may place orders on the website.

Delivery

• Delivery times: Belgium (1-2 days), France (2-4 days), Luxembourg (1-2 days). These times are indicative.

• The customer is responsible for payment of all taxes, duties and delivery-related fees.

• Upon receipt, the customer must check the condition of products and immediately inform AGS S.R.L. of any issues.

• In case of non-receipt despite multiple attempts, the package will be returned and reshipping costs will be borne by the customer.

• The customer undertakes not to resell purchased products.

• Risk transfer occurs upon physical receipt of products by the customer or their representative.

Right of Withdrawal

• The customer has 14 days to return products for exchange or refund, without having to justify any reason.

• Products must be returned at the customer's expense, new and in original packaging, to: AGS S.R.L., rue Barbe d'Or 42, 4317 Aineffe.

• AGS S.R.L. will refund amounts paid (excluding shipping costs and €5 flat rate refund fee) within 14 days.

Payment

• Prices are expressed in euros, including all taxes (VAT included).

• AGS S.R.L. reserves the right to modify prices, but products are billed based on rates in effect at the time of order.

• Payment is required at the time of order through means offered on the website (credit card, etc.).

• The order is validated only after approval from the Stripe secure payment platform.

• Any fraudulent use of a payment method may result in legal proceedings.

Liability

AGS S.R.L. cannot be held responsible for damages resulting from improper use of products or non-compliance with instructions provided by the therapist. AGS S.R.L.'s liability is limited to the order amount and cannot be engaged for errors or omissions in product presentation. In case of force majeure preventing AGS S.R.L. from fulfilling its obligations, these will be suspended for the entire duration of the event.

Privacy

• Personal information collected during ordering is necessary for processing and delivery.

• AGS S.R.L. complies with Belgian legislation on personal data protection. The customer has rights of access, rectification and deletion of their data.

Applicable Law and Dispute Resolution

These Terms and Conditions are subject to Belgian law. In case of dispute, AGS S.R.L. and the customer will seek to find an amicable solution before any legal action. Failing that, only Belgian courts at AGS S.R.L.'s registered office will have jurisdiction to settle the dispute.
